Smokefree: Pubs and Clubs

All pubs, social clubs, working men's clubs, private members clubs, social and sports clubs, are covered by the Smokefree legislation.

Designated "Smoking Areas" in such premises are not allowed.

Pubs and Clubs with Overnight Accommodation

If overnight accommodation is provided, bedrooms may be designated for smoking, but all other parts of the premises must be smokefree.

A bedroom can be designated for smoking if it:

  • Is used exclusivley for sleeping accommodation
  • Has been designated in writing by the person in charge of the premises.
  • Has a ceiling and, except for doors and windows, is completely enclosed on all sides by solid, floor to ceiling walls
  • Does not have a ventilation system that ventilates into other parts of the premises, except any other designated bedrooms to prevent smoke drift
  • Has self-closing doors where any door opens into a smokefree area
  • Is clearly marked as a bedroom in which smoking is permitted

What if my home is above the pub or club, does it have to be smokefree?

No. The legislation does not cover private dwellings.
