Health and Safety Legislation

Health and Safety at Work Legislation is designed to protect the Employer, Self Employed, Employees, Contractors, Customers and Visitors to the district from any dangers arising out of a work activity.

Health and Safety legislation is designed to:

  • Ensure the safety of people, i.e. that a machine, work activity or method of work will not cause anyone physical harm
  • Ensure the health of people, i.e. that a substance, noise or method of work will not cause anyone a health problem and
  • That adequate provision is made for the welfare of workers.

The role of providing advise and the enforcement of the duties under this legislation falls either to the Health and Safety Executive (HSE) or the Local Authority (LA). As a general guide the HSE will look at most manufacturing industries. In Harrogate the L A duties are undertaken by officer's of the Department of Community Services, although you may be more familiar with the name "Environmental Health".

Harrogate Borough Council have a Health and Safety Enforcement Policy in place to help ensure consistency of enforcement action.
