Access to CCTV footage

Our CCTV control room operates to a strict Code of Practice which is reviewed every year.

Here, the code talks about third party access:

  • access to evidence may be obtained in connection with civil disputes by court order or be given to lawyers acting for defendants or victims in connection with criminal proceedings
  • no other access will be allowed unless approved by the person appointed to have day-to-day responsibility for the scheme for reasons which fall within the purposes and objectives of the scheme and in accordance with the Code of Practice

Footage is kept for 31 days before being overwritten. Any requests for CCTV must be via an email or letter. The requester will be sent a Disclosure form to complete, they will also need to provide a letter of intent and permission from the client whom they are presenting. On receipt of all these documents, our legal team will consider the request and decide if the footage can be provided.

A charge is made for providing evidence.

Subject Access Requests (see Section 7 of the Data protection Act)

Under the right of subject access, an individual is entitled only to their own personal data, and not to information relating to other people (unless they are acting on behalf of that person.) An individual wishing to make a request for CCTV must apply in writing to the Legal team, Harrogate Borough Council, Civic Centre, St Lukes Avenue, Harrogate HG1 2AE. There are exemptions within the Act particularly regarding criminal or tax proceedings.

After receiving evidence, you must:

  • make sure it is kept safely and securely
  • not allow anyone to make copies of the DVD
  • not show or allow the DVD to be shown to anyone not directly related to the proceedings the DVD has been provided for
