The Public Sector Equality Duty

The Public Sector Equality Duty was created by the Equality Act 2010 and replaces the race, disability and gender equality duties. The duty came into force in April 2011 and covers age, disability, sex, gender reassignment, pregnancy and maternity, race, religion or belief, sexual orientation marriage and civil partnership.

The duty places a requirement upon Harrogate Borough Council and must have due regard to the need to:

Eliminate unlawful discrimination, harassment and victimisation

  • do not discriminate and ensure everyone is treated equally

Advance equality of opportunity between different groups

  • remove or minimise disadvantages suffered by people due to their protected characteristics
  • take steps to meet the needs of people from protected groups where these are different from the needs of other people
  • encourage people from protected groups to participate in public life or in other activities where their participation is disproportionately low

Foster good relations between different groups

  • tackle prejudice and promote understanding between people from different groups

Harrogate Borough Council is committed to equality in both service provision and employment. The council recognises the diverse nature of the district and endeavours to ensure that customers, employees, potential employees, contractors, partners and clients are treated with dignity and respect. The council opposes all forms of discrimination and undertakes not to discriminate unfairly on the grounds of the Public Sector Equality Duty. Every possible step will be taken into account the diverse nature for individuals and ensure that they are treated fairly and decisions on service provision and employment are based on objective criteria.

The council has to publish information to demonstrate its compliance with the Public Sector Equality Duty by 31 January 2021.

The council also has to publish Equality Objectives to further the aims of the Public Sector Equality Duty by 6 April 2020 and this forms part of the Harrogate Borough Council's Equality Strategy.
