Contaminated land responsibility

We have a duty to try to identify and inspect sites that may have been contaminated in the past and which might pose a risk to health and the environment.

We are also responsible for making sure that sites being redeveloped are investigated and, if necessary, cleaned up.

If you own or occupy contaminated land, or you did in the past, even if you have sold it, you may be responsible for cleaning up the pollution.

The law says the "polluter pays". So, the person or organisation that has polluted the land must deal with it and pay for putting it right. If the previous owner is unknown, the current owner may be responsible. Owners and occupiers of domestic properties are not usually liable for these costs.
