Fly tipping is the illegal deposit of waste on land.
Common items include
- white goods
- construction waste
- household waste
It is a serious criminal offence. On prosecution an individual is liable to an unlimited fine along with up to five years imprisonment.
What to do if you see fly tipped waste
If you see waste fly tipped report it to us and we will investigate. Provide us with as much detail as possible including:
- when you saw the waste fly tipped
- where you saw it, using landmarks and road numbers
- what has been tipped, how much and what it looks like
- car registration, if known, or vehicle details which tipped it
- details of any persons present
- is there any evidence within the waste (please do not tamper or remove any evidence you witness, leave it alone)
Please note if the waste consists of garden cuttings or rubble, mattress or white goods and there is no evidence of who has dumped it, we are very limited in what action can be taken. In the majority of cases, investigations will only go ahead where evidence exists which may point to who is responsible, or witnesses can provide statements that can be followed up.

If you see the following fly tipped please contact the Environment Agency on 0800 807060 as they will lead on an investigation:
- if waste is near or in a watercourse
- there is more than 5m3 of fibrous asbestos
- there is more than 75 litres of potentially hazardous waste in drums or containers
- there is more than 20 tonnes/ 20m3 of waste
Clearance of waste from private land
We are not responsible for clearing waste from private land, the landowner is.
Prevention of fly tipping
Re-use/recycle - if you have items that are in reasonable condition, you could consider donating them to a charity for re-use.
Recycle/dispose- certain items can be collected via the bulky waste collection, for example
- bed bases/mattresses
- white goods
- electrical goods
The cost is £41.00 per two items, or £16.85 if you are in receipt of certain benefits.
Recycle/dispose - take the items and any excess waste that won't fit into your appropriate waste receptacle to the household waste and recycling centres on Wetherby Road, Penny Pot Lane Harrogate or Dallamires Crescent Ripon.
Dispose - employ an individual/business to remove the waste from your property and ensure they dispose of it legitimately, for instance at a household waste and recycling centre or licensed/permitted site.
Check they have a waste carriers licence (Upper Tier) on the Environment Agency's website or by contacting them by telephone on 0370 850 6506.
If you are a householder you must also ask the waste carrier for a receipt documenting the waste that was taken from you and at what cost. If they are not able to provide both of these documents do not employ them.
If you are a business you must also ask the waste carrier for a waste transfer note documenting what waste was taken from you, and who it was given to. You can view an example waste transfer note by visiting the GOV.UK website.
Please note that if you do not make these checks and your waste ends up being fly-tipped then you can be prosecuted.
